In our Privacy Policy ("Privacy Policy"), we explain the practises we carry out with the data, including the information we process to provide our Services. ‍Account: means a unique account created for you to access our Service or parts of our Service.

‍Affiliate: means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, shareholding or other voting securities for the election of directors or other management authority.

‍Application: means the software program provided by the Company that you download on any electronic device, called VOYSMILE

‍Company: (called "the Company", "We", "We" or"Our" in this Agreement) refers to Pitu B.V.

‍Country refers to: Netherlands

‍Data controller: for the purposes of the General DataProtection Regulation (GDPR), refers to the Company as the legal person that alone or jointly with others determines the purposes and means of the processing of Personal Data.

‍Device: means any device that can access the Service, such as a computer, a cell phone or a digital tablet.

‍Personal data: means any information related to you, such asa name, an identification number, location data, online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. is any information that relates to an identified or identifiable individual.

‍Service: refers to the Application.

‍Service provider: means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or people employed by the Company to facilitate the Service, provide theService on behalf of the Company, perform services related to the Service or help the Company analyse how the Service is used. For the purposes of the GDPR, Service Providers are considered Data Processors.

INFORMATION THAT WE COLLECT

VOYSMILE must receive or collect information to operate, provide, improve, understand, customise, endorse and promote our Services, when you use or install ourServices, or access them. In our Services, we include optional functionalities that, if you choose them, we will have to collect additional information to provide you with those functionalities. If applicable, we will notify you about the collection of information. If you decide not to provide the information required for a function, you will not be able to use it. For example, you cannot share your location with your contacts if you do not allow us to collect your location data from your device.

INFORMATION THAT YOU PROVIDE

When you create a VOYSMILE account, you must provide certain basic information (including a profile name of your choice). If you do not provide us with this information, you will not be able to create an account to use our Services. You can add other information to your account, such as the profile photo.

AUTOMATICALLY COLLECTED INFORMATION

We collect information about your activity in our Services, such as data related to service, diagnosis and performance. This includes information about your activity (including how you use our Services, the settings you chose, how you interact with others through them and the time, frequency and duration of your activities and interactions), log files, as well as logs and reports of diagnosis, error, website and performance.

LOCATION INFORMATION

We collect and use precise location information from your device with your permission, such as when you decide to share your location with your contacts or view nearby locations or that other contacts shared with you. There are certain settings that are related to the location information that you can find in the settings of your device or in the settings in the application, such as the option to share location.

THIRD-PARTY INFORMATION

We receive information about you from other users. For example, when other users you know use our Services, they can provide your name and other information (such as the one found in the contact book of their mobile phone), just as you can provide theirs. It is also possible that they send audios to you, to the groups to which you belong. We require these users to have legitimate rights to collect, use and share your information before providing us with any type of data.

USER REPORTS

Just as you can report to other users, these or third parties may decide to report your interactions and messages with them or others about our Services, for example, in order to report possible violations of our Conditions or policies.

DELETE YOUR VOYSMILE ACCOUNT

You can delete your VOYSMILE account at any time (even if you want to revoke the consent granted for us to use your information under applicable law) with our option to delete the account in the application. When you delete your VOYSMILE account, the delivered messages will be deleted from our servers, as well as any other information that we no longer need to operate and provide you with our Services. Remember that deleting your account does not affect the information you created or what other users have about you, such as the copies of the audios you sent them.

LEGISLATION, OUR RIGHTS AND PROTECTION

We access the information described in the Information we collect section of this Privacy Policy, preserve it and share it if, in good faith, we consider it necessary to: (a) respond under the legislation or regulations applicable to legal procedures or government requests; (b) demand compliance with our Conditions, as well as other applicable conditions and policies, including to investigate possible violations; (c) detect, investigate, prevent and address cases of fraud and other illicit activities, or technical or security-related problems; or (d) protect the rights, property and safety of our users, VOYSMILE.

UPDATES TO OUR POLICY

We may modify or update our Privacy Policy. We will notify you of modifications to this Privacy Policy, as appropriate, and update the effective date at the top of this Privacy Policy. Check our Privacy Policy from time to time.
